​​I realised I hadn't checked I was using up to date firmware​​

​here's the
 firmware I have been using for the realtek card

-rw-r--r-- 1 root root 30808 Oct  4 21:19
/lib/firmware/rtlwifi/rtl8723bs_nic.bin

the version in the hadess github repo for the driver:

-rw-r--r-- 1 root root 32108 Feb 29 21:29
/usr/src/rtl8723bs/rtl8723bs_nic.bin


so I renamed all my old firmwares with a date stamp and copied over the new
ones, you can see
​most have changed

I find it odd that the firmware isn't in the main kernel/linux-firmware
github (
http://git.kernel.org/cgit/linux/kernel/git/firmware/linux-firmware.git )
